By entering the facility, you are in Agreement, and you agree to the terms of you and your (dogs) experience with DogGos and WAIVE YOUR RIGHT TO SUE US AND TO EXERCISE OTHER LEGAL RIGHTS.

By Registering for services you are in Agreement, and you agree to the terms of you and your (dogs) experience with DogGos and WAIVE YOUR RIGHT TO SUE US AND TO EXERCISE OTHER LEGAL RIGHTS.

READ ALL TERMS OF THIS AGREEMENT CAREFULLY

TO: 2459880 Alberta Ltd and its respective directors, officers, owners, employees, volunteers, agents, representatives, contractors, advisors, successors and assigns (together the “RELEASEES”)

FROM: You or your dog, your heirs, executors, administrators, parents or guardians,  (together the “PARTICIPANT(S)”)

IN CONSIDERATION OF the covenants and agreements contained in this Agreement and other good and valuable consideration, the receipt of which is hereby acknowledged, the parties to this Agreement agree as follows:

1. Consideration

Being of lawful age and in consideration of being permitted to participate in the services described below, the PARTICIPANT(S) as owner of the PARTICIPANT(S) releases and forever discharges the Service Provider, its owners, directors, officers, employees, agents, assigns, legal representatives and successors from all manner of actions, causes of action, debts, accounts, bonds, contracts, claims and demands for or by reason of any injury to person or property, including injury resulting in the death of the PARTICIPANT(S), which has been or may be sustained as a consequence of the PARTICIPANT(S) participation in the service described below, and not withstanding that such damage, loss or injury may have been caused solely or partly by the negligence of the Service Provider.

The PARTICIPANT(S) understands that the PARTICIPANT(S) would not be permitted to participate in the services described below unless the PARTICIPANT(S) agrees to this Agreement.

2. Details of Service

  • Private Boarding both supervised and unsupervised

  • Boarding in enclosed area with other dogs inside and outside both supervised and unsupervised

  • Feeding and watering

  • Walks inside and  outside of the Facility

  • Transportation of dog(s) within vehicles 

  • Transportation of dog(s)  

  • Grooming services

  • Washing Services 

  • Direct interaction with Dog(s)

  • Indirect interaction with Dog(s)

  • Training of dog(s)

  • Providing medicine of any type under the guidance of the owner(s)

  • Tours and access to the Facilities

 

3. Concurrent Release

The PARTICIPANT(S) acknowledges that this Agreement is given with the express intention of effecting the extinguishment of certain obligations owed to the PARTICIPANT(S) and with the intention of binding the Owner(s)'s spouse, heirs, executors, administrators, legal representatives and assigns.

4. Fitness to Participate

The PARTICIPANT(S) acknowledges that the PARTICIPANT(S) does not have any physical limitations, medical ailments, physical or mental disabilities that would limit or prevent the PARTICIPANT(S) from participating in the above mentioned service. If required, the PARTICIPANT(S) will obtain a medical examination and clearance.

5. Expectations of Dog/Owner

The PARTICIPANT(S) acknowledges that the PARTICIPANT(S) will behave in a calm friendly manner towards all humans, dogs of all sizes and during the  PARTICIPANT(S) participating in the above-mentioned service.

6. Full and Final Settlement

The PARTICIPANT(S) hereby acknowledges and agrees that the PARTICIPANT(S) has carefully read this Agreement, that the PARTICIPANT(S)fully understands the same, and that the PARTICIPANT(S)is freely and voluntarily executing the same.

The PARTICIPANT(S) understands that by signing this Agreement, the PARTICIPANT(S)agrees to be forever prevented from suing or otherwise claiming against the Service  Provider for any property loss or personal injury that the PARTICIPANT(S) may sustain while participating in or preparing for the above noted service.

The PARTICIPANT(S) has been given the opportunity and has been encouraged to seek independent legal advice prior to signing this Agreement.

This Agreement contains the entire agreement between the parties to this Agreement and the terms of this Agreement are contractual and not a mere recital.

7. Abandonment of Dog(s)

7.1 Pick-up. The PARTICIPANT(S) agrees to pick up the dog(s) from the Facility by the scheduled pick-up date and time, and to keep current contact information  on file with the Service Provider.

7.2 Deemed abandonment. If the dog(s) is not picked up within 1 week (7 days) after the scheduled pick-up date and time, and the Service Provider has made reasonable efforts to reach the PARTICIPANT(S)  using the contact information on file without receiving a response or arrangements for pick-up, the dog(s) will be deemed abandoned.

7.3 Service Provider's rights. Once the dog(s) is deemed abandoned, the PARTICIPANT(S) authorizes the Service Provider, without further notice, to do any or all of the following: (a) continue to board and care for the dog(s) at the PARTICIPANT(S)'s expense; (b) obtain veterinary care for the dog(s) as the Service Provider considers necessary; (c) surrender or transfer the dog(s) to a humane society, SPCA, animal shelter, rescue organization or other suitable caregiver; and (d) place the dog(s) for adoption or rehoming. To the extent permitted by law, the PARTICIPANT(S) transfers all rights of ownership in the dog(s) to the Service Provider upon deemed abandonment.

7.4 Continuing liability. The PARTICIPANT(S) remains responsible for all unpaid fees, boarding charges accrued through the date of abandonment and afterward until the dog(s) is transferred, veterinary expenses, and reasonable costs of care, transport and transfer, and agrees the Service Provider may recover these amounts.

7.5 Release. The PARTICIPANT(S) releases the Service Provider and the RELEASEES from all claims arising from any action taken under this section, including claims relating to the placement, adoption, rehoming or care of the dog(s).

8. Governing Law

This Agreement will be governed by and construed in accordance with the laws of the Province of Alberta.
